Terms of Service

Welcome to Fokus. These Terms of Service ("Terms") govern your access to and use of the Fokus platform, website, and mobile application (collectively, the "Service"), operated by Fokus ("we," "our," or "us").

By creating an account or using Fokus, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using Fokus, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Fokus.

We reserve the right to update these Terms at any time. We will notify you of material changes via email or in-app notice. Continued use after notice constitutes acceptance.

2. Who Can Use Fokus

  • Adults (18+): may create and manage their own accounts.
  • Teens (13–17): may use Fokus with parental awareness. By creating an account, teens represent that their parent or guardian is aware of their use.
  • Children (under 13): may only use Fokus through an account created and managed by a parent or legal guardian. Verifiable parental consent is required before any personal information is collected.

By creating a child's account, the parent or guardian accepts these Terms on the child's behalf and takes full responsibility for supervising the child's use of the Service.

3. Accounts

  • You are responsible for keeping your account credentials confidential.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at lethalinjection967@gmail.com if you suspect unauthorized access.
  • You may not create more than one account per person or transfer your account to another person.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

  • Fokus offers free and paid subscription plans. Paid plans are billed on a recurring monthly or annual basis.
  • All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial-period refunds are issued unless required by law.
  • We reserve the right to change our pricing with 30 days' advance notice. Continued use after the effective date constitutes acceptance of new pricing.
  • Trials (if offered) automatically convert to a paid plan at the end of the trial period. You can cancel before the trial ends to avoid charges.
  • All fees are in US dollars (USD) unless otherwise stated.

5. Acceptable Use

You agree not to:

  • Use Fokus for any unlawful purpose or in violation of any applicable laws
  • Attempt to access another user's account without permission
  • Upload or transmit harmful, offensive, or inappropriate content
  • Reverse engineer, decompile, or attempt to extract source code from Fokus
  • Use automated bots, scrapers, or other tools to access the Service without our written consent
  • Interfere with or disrupt the integrity or performance of the Service
  • Impersonate any person or entity

6. Intellectual Property

All content, features, and functionality of Fokus — including but not limited to text, graphics, logos, icons, images, audio clips, and software — are the exclusive property of Fokus and are protected by US and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial purposes.

7. User Content

You retain ownership of any content you submit to Fokus (task names, notes, mood logs, etc.). By submitting content, you grant Fokus a non-exclusive license to store and display that content solely to provide the Service to you.

We do not use your personal content for training AI models or for advertising.

8. Not a Medical Service

Important: Fokus is an organizational and productivity support tool. It is not a medical service, mental health treatment, or therapy platform. Nothing in the Service constitutes medical advice, diagnosis, or treatment.

Fokus is not a substitute for professional medical evaluation, diagnosis, or treatment of ADHD or any other condition. Always consult a qualified healthcare professional for medical concerns. Never disregard professional medical advice or delay seeking it because of something you read or experienced on Fokus.

If you or your child is experiencing a mental health emergency, call or text 988 (Suicide & Crisis Lifeline) or contact your local emergency services immediately.

9. Parental Responsibility

Parents and guardians who create accounts for children under 13 are solely responsible for:

  • Supervising their child's use of Fokus
  • Ensuring the child's use is appropriate and safe
  • Keeping account credentials secure
  • Reviewing and managing the personal information associated with their child's profile

We encourage parents to use the Family Hub features to monitor their child's progress and activity within the app.

10. Podcast Guest Participation

If you submit a request to appear as a guest on the Fokus podcast:

  • You grant Fokus a non-exclusive, royalty-free license to record, edit, publish, and distribute the episode across podcast platforms
  • You confirm that any personal story or information you share is accurate and that you have the right to share it
  • Submission of a guest request does not guarantee an invitation to appear
  • Episodes featuring minors require written parental or guardian consent prior to recording
  • You may withdraw from an episode before recording; once recorded and published, Fokus is not obligated to remove it

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOKUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Fokus and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
